一、（US now formally recognizes Syria's main opposition coalition as "the legitimate representative" of the Syrian people）按《中國時報》2012年12月13日報導：【美 國總統歐巴馬十一日宣布，美國承認敘利亞反對勢力「全國聯盟」為敘國人民的「合法代表」。這是美國迄今對該國慘烈內戰最重大的一次介入，意在進一步向敘利 亞軍事強人巴夏．阿塞德施壓。而對最近才重組成立的「全國聯盟」而言，贏得美國的承認，無疑是一項重大勝利。由反對巴夏政權的國家所召開的「敘利亞之友」 國際會議，十二日在摩洛哥馬拉喀什舉行。歐巴馬在會議前夕接受美國廣播公司新聞網（ABC NEWS） 訪問時表示：「我們已做成決定，敘利亞的反對勢力聯盟包容性已足夠，足以反映並代表敘國人民，我們視他們為敘國人民的合法代表」。美國國務卿希拉蕊．柯林 頓原先計畫參加會議、並在會上宣布承認「全國聯盟」，後來因病取消行程。不過，在敘利亞北部阿勒坡的伊斯蘭聖戰士反抗軍拒絕加入「全國聯盟」，其中包括 「努斯拉陣線」（Al-Nusra Front），他們志在建立一個伊斯蘭國家。美國官員擔心， 「努斯拉陣線」試圖綁架革命。由於「努斯拉陣線」與「基地」恐怖組織有往來，歐巴馬已宣布把「努斯拉陣線」列為恐怖組織。美國採取緩慢、漸近方式，承認敘 利亞反對勢力「全國聯盟」，從而加入法、英、土耳其及「波斯灣合作理事會」（ＧＣＣ）行列。敘國總統巴夏．阿塞德最強大的盟友俄羅斯，對美國承認敘國反對 勢力表示驚訝。俄國外長拉夫羅夫指出：「美國已決定把所有賭注放在『全國聯盟』武力造反獲勝之上。」有超過一百卅個國家的代表參加「敘利亞之友」國際會 議，其中包括約六十名部長、敘國反對勢力以及國際組織，但不包括俄羅斯、中國和伊朗，這三國仍支持巴夏政權。「敘利亞之友」大會將發布宣言，承認「全國聯 盟」為敘國人民唯一合法代表。大會並將呼籲巴夏．阿塞德下台，並警告他不得使用化學武器。】

二、國家承認（Recognition of States） vs 政府承認（Recognition of governments）[1]

（一）國家承認

1、“constitutive” schools of thought：A State only becomes a State by virtue of recognition / recognition is status-creating （Stefan Talmon）

2、“declaratory” schools of thought：A State is a State because it is a State, that is, because it meets all the international legal criteria for statehood/ recognition is merely status-confirming （Stefan Talmon）

（二）政府承認

When a State recognizes a new “government,” it usually acknowledges a person or group of persons as competent to act as the organ of the State and to represent it in its international relations. The only criterion in international law for the recognition of an authority as the government of a State is its exercise of effective control over the State’s territory.（Stefan Talmon）
